[Photo|Busia County Government]Busia High Court Judge Kiarie Waweru will on Tuesday (today) make a ruling on an application filed by former Funyula MP Paul Otuoma to be included as a witness in the election petition filed by his former Chief campaigner Paul Odima challenging the re-election of Governor Sospeter Ojaamong.The application met heated argument over its legal implications among the IEBC lawyer Chrysostom Akhaabi, Steve Ligunya (for governor Ojaamong) and David Ochieng (for Peter Odima - the petitioner).Ochieng’ in his request said that most of the matters mentioned in the petition touched on his client.IEBC's lawyer Akhaabi said the petitioner should have determined the scope of his petition before filing it, adding that the respondents was given complete answers to the allegations being made by the petitioner.Ojaamong’s lawyer Steve Ligunya argued that if allowed, the application will allow the petitioner to amend his case by narrowing down to one witness, Paul Otuoma.“My lord indeed, the application is devoid of any explanation as to why that affidavit was not filed alongside the petition,” he said.He said allowing the application will translate to allowing introduction of new materials because the respondents do not know what kind of material they want to add.Ligunya said Otuoma’s name has been mentioned severally in the petitioner's affidavit and it was foreseeable that he should have been included as a witness, but they failed to do so within the 28 days as per the law.
