Former Kathiani MP Wavinya Ndeti’s case challenging Machakos Governor Dr. Alfred Mutua’s win continued on Tuesday. 

The Independent Election and Boundaries Commission (IEBC) lawyers tore into her affidavit in which she argued that the August General polls was not conducted in a free and fair manner as expected.

Through lawyer Kimani Muhoro, the IEBC defense team told the High court that Ndeti had not presented them with official appointment letters of her agents even when some them when mentioned as witnesses in the case against the Maendeleo Chap Chap Movement leader.  

The defense lawyer Muhoro also engaged Ndeti’s lawyer Fred Gitonga for allegedly prompting her while the case was being heard. 

The Presiding Justice Aggrey Muchelule issued a stun warning to Gitonga against this. He told the complainants that Ndeti should have gone through her affidavit before presenting the witnesses to testify against the incumbent county boss.

The court said that Ndeti should have read the affidavit at least before signing the same to avoid issues. 

On his part, Mutua has maintained that his win reflects the will of the people of Machakos. The governor argues that Ndeti’s decision to move to court after suffering what he terms as humiliating defeat is meant to derail him from delivering on his promise.
