A Kisumu court will on May 9 deliver a judgement for a defilement case involving a 24-year-old woman and a minor.

Judith Wandera pleaded guilty of defiling a 14-year-old boy, an offence which got her arrested on July 7, 2016.

Appearing before Principal Magistrate Joan Wambilyanga, Wandera, however, defended her actions stating that she could not establish the age of the defendant when she first met him.

“We met at a drinking joint one evening of April 2016 in Kondele where he even offered to buy me drinks. We exchanged phone contacts and started dating,” Wandera told the court. 

Wandera further claimed that the boy was a drug abuser, and also a bodaboda operator adding that he only appeared young when he was present before the court to testify.

“He had dreadlocks on his head when we met, however, after being taken to juvenile, the dreadlocks were cut down after which he appeared very young when he came to testify before the court,” stated Wandera.  

According to the testimonies by the parents of the minor,  their son was a class 7 pupil at Manyatta Arabs primary but ceased attending school after meeting Wandera.

The parents also stated that they reported the matter to the police, who arrested Wandera following reports that their son had already moved in with the accused.

Wandera, however, argued that she started putting up with the boy after he came to her place claiming that her parents had excommunicated him citing that he was not hardworking. 

The Prosecutor of the case, Nyakundi Mukaya disclosed that medical evidence from specimens collected from the duo indeed confirmed that the woman and the schoolboy were having an intimate affair.

Mukaya also added that the two had stayed together for at least four months.

“After the arrest, the boy was taken to a juvenile correctional facility after which he was handed back to his parents,” stated Mokaya.
