In his ruling, Ogoti dismissed an application by Kidero through his lawyer James Orengo to have the charges drop on grounds that they were charging him using a non existent law.

But the Magistrate maintains that there were enough grounds to have the case moving to full trial, a move that his literally thrown Dr Kidero to drawing board.

He's accused, together with others, of a conspiracy to steal Sh223 million from Nairobi County, a claim he has however dismissed as witch-hunt.

Directors of the companies linked to the saga also lost their bid to have them charged together as companies and not as directors. The move further complicates the case against Kidero.

He is charged alongside former Nairobi county secretary Lillian Ndegwa, former chief finance officer Jimmy Mutuku Kiamba among others.

Other charges include abuse of office and fraudulent acquisition of public property. The trial will start on May 6.

Dr Kidero has been facing a myriad of court cases since his exit and has often blamed his successor Mike Sonko. He was arrested by EACC last year over corruption related cases.
