Former Machakos Senator Johnson Muthama has for a long time been embroiled in a bitter legal tussle with his estranged wife Agnes Kavindu Musyoka.

The High Court on Friday ruled in Muthama's favor after his divorced spouse’s effort to remain in a house which he owns backfired. 

The court ruled that Kavindu was living in the Wiper politician’s house at his will and not wife as she had claimed earlier on. 

While delivering her ruling in the case that attracted the attention of many from the region, Justice William Musyoka said the woman was accommodated because she is the mother to Muthama’s daughter and nothing else. 

The ruling was made after the court heard testimonies from both sides. 

“The picture that emerged was not that of a spouse but of a person accommodated initially as a mother of the respondent’s daughter,” Musyoka ruled over the property located in Mua, Machakos County.

Muthama and Kavindu got married in 1975 under the Kamba customary law but the marriage was ended in 1983 after they got three children. 

In 1996, the two allegedly remarried and bore a daughter, but Muthama dismissed the second marital affair.

In 2014, Kavindu decided to seek legal redress after Muthama threatened to evict her from the house.
