IEBC Chairman Chebukati survives ouster

Parliament has rejected the Public Accounts Committee (PAC) report seeking to oust the Independent Electoral and Boundaries Commission (IEBC). 

According to the report, IEBC chairman Wafula Chebukati, commissioners Abdi Guliye and Boya Molu are unfit to hold public offices. 

The committee put the team on spot over the alleged misappropriation of the public during the 2017 General Elections in which President Uhuru Kenyatta’s win was nullified by Chief Justice David Maraga.

 While delivering his ruling on the matter, National Assembly Speaker Justin Muturi said that parliamentary watchdog has no authority to dismiss the commissioners. 

The committee under the chairmanship of Opiyo Wandayi-led had hatched a plan to ensure the team leaves office with immediate effect before the ruling was made. 

The constitution outlines that a commissioner can only send home by a petition filed through National Assembly. 

Some of the reasons that can lead to the ouster of a commissioner include mental and physical incapacity, bankruptcy and incompetence among others. 

“Finding or recommendation by the Public Accounts Committee in the report tabled before the House which expressly falls outside the mandate of the Committee,” ruled Muturi, as quoted by Standard.

 The Members said that the committee overstepped its authority in the ouster of the commissioners from office. Chebukati has been put on the spotlight on several occasions after overseeing the elections in 2017.
