Embakasi South residents have reacted to the Court of Appeal ruling that nullified area MP Julius Mawathe's election.

The residents mostly of Kamba origin say that the court of appeal erred in nullifying the MP’s election.

According to residents,  Mawathe won fairly and that there was s no reason to nullify his victory.

“We feel disappointed about the ruling and ask 'mheshimiwa' to appeal it in the Supreme Court,” Mercy Mutheu said in an interview on Sunday.

Mutheu said that it was not fair for the court to nullify the election,  saying that it will be expensive to conduct a by-election.

She however said that they (Embakasi South)  people will vote Mawathe back in case of a by-election.

“The courts should be reasonable and weigh on the cost of conducting by-election before making such rulings,” Stephen Mbula said.

Mbula a bodaboda operator said that taxpayers are the people feeling the pinch when by-elections are conducted.

“As much we advocate for electoral justice and fairness, the courts should not blatantly issue rulings without considering the effects they have on the economy,” he added.

Benson Muli a fruits vendor said that Mawathe’s election nullification was within the law.

He claimed that Embakasi South 2017 election was not free and fair.

“Justice has been served to us and us we ready for the ballot because he (Mawathe) rigged himself in 2017,” he alleged.

The residents however appealed to peace and calm following the election nullification.

The Wiper MP has announced that he will be heading to the Supreme Court to challenge the ruling by the court of appeal.

Court of Appeal judges Daniel Masinga, Mohamed Warsama and Kathurima Minot on Friday nullified Mawathe's victory on grounds that the parliamentary election was not free and fair.

The appeal had been lodged by former ODM  MP Sumra Irshada Mohamed after the High court had upheld Mawathe’s victory in March.

Sumra now says he is ready for the by-election as ordered by the court of appeal.
