In a tweet moments after Alai's arrest, the lawyer confirmed that posting pictures of terror attack victims is punishable by the law.

"Publishing pictures of dead victims of terrorism isn’t protected by the Constitution & it violates Sections 19, 27, 30A, 30E & 30F Of The Prevention Of Terrorism Act, No. 30 of 2012. Freedom of Media & Expression aren’t absolute. Supporting actions of Terrorism is Terrorism," said Donald Kipkorir.

Alai was arrested on Tuesday morning by the detectives from the Directorate of Criminal Investigation (DCI) a day after posting pictures of police officers who were killed in the Wajir terror attack on Saturday.

National Cohesion and Integration Commission (NCIC) together with the National Police Service (NPS) condemned him for this act pointing out that it supports terrorism.

In a statement from the NCIC, the act of posting pictures of fallen soldiers by Robert Alai was termed as inhumane.

“The unfeeling act of posting pictures of our fallen heroes online by one blogger is very unfortunate and inhumane,” read the statement in parts.
