Nyamira Assembly Speaker Moffat Teya will now have to officially write to IEBC to inform it about reinstatement of Ms Irene Mayaka to the assembly after several months of absence.

For close to two years, Ms Mayaka, who led Raila Odinga's popular campaigns dubbed 'Daughters of Raila', has been literally in courts fighting for the removal of Damaris Mouni, who also rightfully claimed to have been nominated by ODM.

Appeals Court Judges Hannah Okwengu, J. Mohammed and Erastus Githinji, ruled that the court had no jurisdiction to hear and determine another a case that had been appealed in the lower courts.

And as such, such Ms Mayaka won in both Magistrate and High Court, Mrs Mouni will now automatically lose the seat in favour of Mayaka after 18 months of defense.

"I am very happy. I have been waiting for this. The party rightfully nominated me but someone rigged me out. Justice has been served. I'll serve the speaker with the ruling," she said on phone.

Speaker Teya confirmed that he had not received the ruling but said he will study and make appropriate interpretation according to the law.

"I haven't received the ruling. I'll make the decision once I get it. My obligation is just to obey the court orders," Teya said in a text message.

Last year, Mouni was kicked out of the assembly in favour of Mayaka but the former rushed to court and subsequently obtained orders barring the latter from taking over.

It's alleged that Mouni used her connections with IEBC to tamper with ODM nomination list, thus expunging Ms Mayaka'a name without the party's knowledge.
