Director of Public Prosecution Noordin Haji has yet again put a vicious fight in the prosecution of Deputy Chief Justice Philomena Mwilu as the corruption case against her takes new twist.

Early this year, Mr Haji's team managed to convince Chief Justice David Maraga to constitute a five bench judge to handle the corruption case against Judge Mwilu.

On Monday, Mr Haji's team opposed the application by three other entities seeking to be enjoined in the petition seeking to stop prosecution of Mwilu, the most senior judge to be implicated in graft in the recent history."DPP has opposed application by FIDA Kenya, ICJ Kenya & Advocate Adrian Kamotho to be enjoined in DCJ Philomena Mwilu’s petition since they don't meet the threshold to be enjoined in the petition," his office wrote on Twitter.

Mr Haji added: "Secretary Public Prosecutions, Dorcas Oduor, asked the five Judge bench comprising Justices: Hellen Omondi, Mumbi Ngugi, Francis Tuiyott, William Musyoka & Chacha Mwita to dismiss the applications. The petition is seeking to block Mwilu's prosecution."

Mrs Mwilu, wife to Busia Senator Amos Wako, was dragged to court last year over tax evasion and collapsing of Imperial Bank, allegations she has often maintained that are politically instigated.

In her statement after being arrested by DCI and DPP, Mwilu accused President Uhuru Kenyatta of witch-hunt, adding that her woes had something to do with 2017 Presidential Petition in which Uhuru lost to Raila Odinga.

Lawyers James Orengo, Okong'o Mogeni and Nelson Havi have been fighting for the DCJ in court and are seeking to block her prosecution.
