British prosecutor Khawar Qureshi on Thursday made his first appearance in court in the ongoing case implicating Deputy Chief Justice Philomena Mwilu in alleged graft activities.

Qureshi is in the nation courtesy of the Office of the Director of Public Prosecution which has sought his services mainly for the prosecution of Mwilu's case.

But in court, his appointment was questioned by the defense lawyers led by Siaya Senator James Orengo who termed his presence in the courts as illegal.

Orengo and his team accused the Director of Public Prosecutions Noordin Haji of illegally importing the Briton who lacks the needed certifications to operate in Kenyan courts.

''Although the Attorney General has the discretion to do so, he has to do more than writing a letter. It must have evidence in regards to the role of advocates,'' he said as quoted by Citizen Digital.

In his defense, the prosecution noted Qureshi's nomination was conducted in line with the required procedure.

Orengo argued that the papers tabled by the ODPP, including a practicing certificate are not enough to justify his inclusion in the case, and now wants him excluded from the continuation of the hearing set for Wednesday.

Mwilu was arrested and arraigned before the Anti-Corruption Court in Nairobi over allegations of misuse of power and siphoning funds from the troubled Imperial Bank.
