Hearing of a forgery case against Kapkures ward MCA Paul Kimtai together with his close aide, Richard Langat, has again been adjourned as the magistrate was indisposed.
The case which had been listed for hearing has stalled for the last one year.
On Monday, chief magistrate Josephat Kalo adjourned the matter to October 12 stating that the court handling the case was not sitting.
He directed that the parties appear before the trail court for fixing of a hearing date.
"The magistrate handling the matter is away on official duties, the case will be mentioned on February 26 for fixing of a hearing date," Kalo said.
During the last mention of the case, lawyer Gordon Ogolla for the ward representative had applied to have the trial stopped saying they had reached an agreement to settle the matter out of court.
The trial court had granted the defense three weeks to conclude negotiations of settling the matter and appear before it to present progress.
The duo who were arrested in 2017, had been charged with forgery of land titles of a plot within Nakuru.
It was alleged that on diverse dates between the month of October 2010 and April 2012 at an unknown place with intent to defraud Josiah Njoroge without lawful authority made a title deed of a land situated at Mbaruk area in Nakuru purporting to be a genuine document issued by the land's registry.
They faced other charges of giving false information to police about the said land which led to the wrongful arrest of a land's advocate in Nakuru.
Particulars of the charge sheet were that on April 14, 2014, at the CID offices in Nakuru County willingly gave false information to a police officer who was investigating the said forgery of the documents which led to the arrest and subsequent charge of an advocate wrongfully.
The two had pleaded not guilty and are out on a sh200, 000 bond with a surety of the same amount.
