President Uhuru Kenyatta and ODM leader Raila Odinga may be forced to recall Bulding Bridges Initiative Task Force following a suite in court.

Researcher Moraa Gesicho has challenged the constitutionality of the Task Force arguing that it's unconstitutional.

“President Kenyatta and Raila’s brazen violation of the Constitution by using their personal interests rather than the people’s interests must not be allowed to continue. Their proposal for the task force is an invitation to anarchy since it undermines the rule of law,” said Gesicho.

According to her, the outcome of the process would still lack constitutional support thus illegal.

Further, she says, the process is a large scheme by the duo to change the constitution using backdoor means.

“The Constitution does not allow the President to seek assistance from the leader of Opposition in the governance of the country. The only people mandated to assist him in governance are the Deputy President and Cabinet secretaries."

The cooperation, she adds, is a scheme to establish a secret government other than that recognised by the constitution.

“President Uhuru and Raila are using the task force to establish a government not recognised by the Constitution. It is the reason why the task force must be stopped before it makes recommendations not supported by the public."

Constitutional expert and former presidential candidate Ekuru Aukot had also threatened to move to court over the Task Force.

Since March, the country has experienced relative stability after the two leaders agreed to settle their political differences.

In his public address recently, Uhuru asked politicians to keep off his deal with Raila.

"The handshake has a deeper understanding between me and Raila. Kindly do not politicise it," he said.
