Prof. Olive Mugenda has been handed a reprieve after the court ruled in her favour in a case seeking to revoke her appointment as Non-Executive Chairperson of the Kenyatta University Teaching, Referral and Research Hospital board.

Activist Okiya Omtata has moved to court to block former Kenyatta University Vice-Chancellor from taking over the office.

The activist argued that President Uhuru Kenyatta failed to follow the right process in the appointment. 

The Employment and Labour Relations, however, ruled that it cannot stop the appointment since he was unable to prove that the President flouted appointment procedures. 

Uhuru had also appointed Kithinji Kiragu and Gladys Ogallo as members of the board before the activist moved to court over the same.

Omtata wanted the three subjected to a vetting process based on fairness and merit. 

The activist insisted that the public was not involved in the process of appointment.

“The PSC then conducts interviews and avails an opportunity for public participation before appointing persons to the offices or submitting the names of successful candidates to appointing authorities for the appointment,” reads the court documents, as quoted by Citizen.

The activist also said that the process is still a member of the institution and she cannot be appointed to chair the hospital’s board.
