The move created cracks in the party given that ex-Kitui Senator and Wiper Chairman David Musila was gunning for the seat. With the decision to hand Malombe a direct ticket, Musila was pushed to the periphery.

This move led to great hue and cry by voters from the county calling out the party over its decision to hand Malombe a direct ticket leaving Musila on the edge.

He, however, vied for the seat as an independent candidate.

As punishment to Wiper, Kitui voters cast their votes in plenty for Narc's Charity Ngilu who proceeded to take the realms of power in Kitui as the Governor.

Malombe was dissatisfied with the results and filed a petition at the High Court and later at the Court of Appeal. His petition has been ruled in Ngilu's favour forcing him to move to the Supreme Court in the hope of getting a lifeline in his political career.

The same case was witnessed in Machakos County where former Kathiani lawmaker Wavinya Ndeti was handed a direct ticket to vie for the gubernatorial seat.

The aftermath has been a long protracted petition battle that is now at the Supreme Court pitting Wavinya against Maendeleo Chap Chap's Alfred Mutua who was declared the winner by IEBC in the August 8, 2017 polls.
