Gatundu South Member of Parliament Moses Kuria has been handed a reprieve after the Director of Public Prosecution closed the incitement to violence case against him.

Kuria has a reason to smile after State prosecutor Kajuju Kirimi revealed the closure of the case at a Milimani court on Tuesday. 

The closure of the case comes after the cyber-crime expert Chief Inspector Alexander Mathenge Tiha said that the report on the video recording was different from what the office of the DCI had requested him to do. 

Tiha had been second by the office of the DCI to the communication Authority to release a report on the matter before the closure of the case. Mr Tiha said that he had been instructed by the DCI to examine the recording of the lawmaker and former Machakos Senator Johnston Muthama. 

The recording allegedly targeted Former Prime Minister Raila Odinga and his wife Ida following the nullification of President Uhuru Kenyatta and his Deputy William Ruto’s victory. 

Tiha told Chief Magistrate Francis Andayi that he had presented the findings from the recording to the DCI. 

The clip showed the lawmaker appealing to the voters not to elect Raila. The video didn’t capture the alleged 16 abusive words Kuria had uttered against Raila. 

“My report does not rhyme with the words contained in the charge sheet," he said in part, as Daily Nation quoted him.
