A family in Kano Plains in Kisumu County is yet to agree on the burial of their relative a businessman who died three years ago.

The man died sometime in 2016, but his body remains in the morgue as two factions of the family continue to engage each other in an unending land row.

The battle began in 2016 when three of the man's children managed to acquire court orders preventing his burial in Ofunyu Village, Kisumu East constituency.

This came as the businessman's second and only surviving wife Jane Awino attempted to bury him at her home, an attempt that was suppressed by the first wife’s children.

In the middle of the row is a succession battle with each side seeking to keep the late businessman’s estate.

Ms Awino who in February last year got an order from the High Court allowing her to bury the man at the homestead after two unsuccessful counter appeals is opposed to the trio’s demand that he be buried at the family cemetery.

“That the appellant Jane Awino Onyango as the surviving widow shall lead the funeral arrangements together with her (nine) children and those of the deceased first wife and shall ensure participation of the entire family in the funeral and burial arrangements,’’ read the ruling under civil appeal number 39 of 2017, as quoted by the Standard.

The row has since proved too hard to cool even for Luo elders, as the body continues to lie at the Avenue Hospital Mortuary in Kisumu.
