Senior Counsel Ahmednassir Abdullahi has weighed in after Secretary of Innovation, Digital and Diaspora Communication in the Office of the Deputy President Dennis Itumbi was released from police custody.

In a tweet on Wednesday, lawyer Ahmednassir noted that the mandate of dictating bail terms has been shifted to the police.

"The Judiciary under CJ Maraga has transferred bail/bond issues to the police..accused persons are given bail/bond only on terms DICTATED to magistrates by the Police," he said in a tweet.

The lawyer was reacting after Itumbi who had been in custody since Thursday last week after being arrested over the alleged fake letter in a plot to assassinate Deputy President William Ruto was released on an Sh100,000 bail term.

Ahmednassir also noted that individuals who are arrested in politically sensitive matters are prosecuted as dictated by the police. 

"It really doesn't matter who the accused on the dock is. Magistrates probably under EXPRESS instructions from CJ Maraga have made the CONSTITUTIONAL right to bail/bond a mirage..an illusion. Accused persons in POLITICALLY sensitive cases are kept in police cells as per police order," he noted in another tweet.

When arraigned before a Nairobi court, Itumbi denied being the source of the letter which was shared on various social media sites.
