Mariga was disqualified from contesting for Kibra by-election on Jubilee party ticket after it emerged that his name was not appearing in the register.

Already, Director of Criminal Investigation George Kinoti's team has reportedly taken over, with Mariga's age also being probed for possible fraud.

While Mr Mariga indicates that he was born in 1987, the serials of his national ID card belongs to people born in 90s. It is not clear why he delayed to apply for ID.

Also, DCI is also investigating circumstances under which he applied to be a voter. While is is not a big issue, it is believed that the card may not be genuine.

But the former Inter Milan midfielder has appealed IEBC's decision, arguing that his rights are being infringed despite being a registered voter.

“I have filed the complaint to challenge the decision of the Returning Officer Beatrice Muli for invalidating my nomination as a candidate for the Jubilee Party. The decision violates my rights and fundamental freedom protected by the Constitution and the Election Act,” read Mariga’s affidavit in summary.

“I verily believe to be true that the law allows for continuous registrations as voter under the Election Act Section 5(1) and the voter registers are being updated continuously as per the respected laws,” read the affidavit.

This comes even as cracks continues to widen in his Jubilee Party. Already, a voter wants Secretary General Raphael Tuju sacked from his position.

Mr Patrick Kabundu insists that Tuju is a state officer thus he should not be allowed to hold a party position. He had initially opposed Mariga's candidature.

“The officers who had taken the oath of office had sworn to protect the Constitution and that accordingly, they should not be in breach of it. Jubilee leaders have contravened the Constitution by holding a political party post while they are State officers,” he said.
