A petitioner has filed a suit seeking to remove Chief Justice David Maraga from office.

According to the petitioner, Fredrick Obilo, Maraga doesn’t deserve to be in office after he failed to constitute a bench to oversee the lease agreement of the commercial building known as Elgon Place for use by Court of Appeal judges in 2013. 

He said that the boss of the Judiciary flaunted laws in the process.

In the petition, which was presented to the Judicial Service Commission, Obilo wants Maraga to explain why he decided to ignore laws of procurement in the lease of the property. 

He also said that there has been a court case against Judiciary after it failed to pay rent towards the same since 2016. 

He also faulted the JSC for the failure to pay service charges for the building despite completion as well as possession of the lease agreement. He told the commission that the building was taken over on January 1, 2013, to house the new Court of Appeal but rent and service fees remain unpaid.

 “The failure by the CJ to act on a matter despite his knowledge is a calculated path of abdication of duty and violates the Constitution, the code of judicial conduct as well as principles of judicial independence,” said Obilo.

He blamed Maraga for not helping the aggrieved party find a solution towards the problem.
