National Treasury Cabinet Secretary (CS) Henry Rotich and his co-accused persons have been barred from accessing their offices after pleading not guilty to graft charges in the multi-billion Arror and Kimwarer dams scandal case.

On Tuesday while granting the CS and other accused persons bail, Milimani Anti-Corruption Chief Magistrate Douglas Ogoti termed Treasury a scene of crime.

“The places of work of all the accused persons are considered scenes of crime and they should keep away. If there is any need to visit their places of work that should be done in the presence of the Investigating Officer,” Ogoti ruled.

The court also warned the accused persons against tampering with evidence in any form or approaching witnesses in the case.

The Treasury CS, his PS Kamau Thugge and their co-accused were charged with willful failure to comply with applicable procurement procedures and guidelines as well as engaging in a project without prior planning.

Others charged alongside CS Rotich are East African Community PS Susan Jemtai Koech and Kerio Valley Development Authority (KVDA) former Managing Director David Kipchumba Kimosop.

The court, however, granted CS Rotich his PS Thugge Sh50 million bond with one surety of a similar amount or alternative of Sh15 million cash bail each.

 The Office of Director of Public Prosecutions did not oppose the release of the suspects on bond or bail.

The DPP through special prosecutor Taib Ali Taib told the court that he has concrete evidence to prosecute the suspects.

The case will be mentioned on August 8.
