In a tweet on Friday, Murkomen questioned what kind of powers Waititu now has since the Court of Appeal upheld a ruling that bars him from office but maintained that he is not suspended nor out of office.

“The Court of Appeal held that Governor Waititu is neither suspended nor removed from office and unlike appointed public officers he is still entitled to his full pay not half. In essence what exactly has happened to Waititu? Can he, for example, reshuffle his CECs @ahmednasirlaw,” he tweeted.

His remarks come after the Court of Appeal upheld Justice Mumbi Ngugi’s ruling, which bars governors accused of graft from accessing their offices.

Waititu had hinted of running a parallel office before the Director of Public Prosecutions (DPP) Nordin Haji warned him against it.

The governor has maintained that he is innocent in the Sh588 million graft case he is facing.

Deputy Governor James Nyoro assumed Waititu's role in an acting capacity after he was charged with graft. On Thursday, Kiambu MCAs impeached him.
