While delivering her ruling on the matter, Employment and Labour Relations Court Judge Hellen Wasilwa said that parliament failed to exercise its powers during the vetting process before the names were presented to President Uhuru Kenyatta.

Wasilwa further noted that parliament overstepped its mandate after giving the duo the green light to assume their new offices.

She said that the process was not only illegal but also undertaken without following the stated procedures.

"It is my finding that nomination of the two as members of NLC was unconstitutional flouting principles of appointment in public service," the judge said on Thursday.

Others who had been appointed are Gershom Otachi as the NLC chairman, Former Labour CS Kazungu Kambi, former Egerton University vice-chancellor James Tuitoek, Hubbie Hussein Al-Haji, Gertrude Nduku, James Tuitoek, Getrude Nguku, Reginald Okumu, Alister Mutugi and Reginald Okumu.

Esther Murugi's nomination to NLC sparked uproar among a section of Kenyans who faulted President Uhuru for giving government jobs to retired politicians.
