A British terror suspect convicted over forgery charges has appealed in a Mombasa Court against his 9-year sentence.

Mr Jermaine Grant in his application wants his conviction and sentence quashed on grounds that the court erred in law.

Mr Grant argued that Justice Martin Muya in his ruling failed to critically re-evaluate the record of evidence tendered before a magistrate’s court when he overturned his acquittal.

Mr Grant was facing nine charges for attempting to illegally acquire Kenyan Identification documents.

He was being accused of attempting to register for a Kenyan birth certificate by making a false statement.

Mr Grant was also facing three counts of procuring execution of a document by false pretense and attempting to produce registration.

The court heard that the appellant had committed the offence on various dates in 2011.

During his case hearing, Mr Grant had been acquitted by Shanzu Principal Magistrate Diana Mochache of the charges but the Director of Public Prosecutions appealed the decision at the High Court.

Judge Muya in his ruling said the magistrate failed to take into consideration the fact that the accused was an accomplice in the forgery of a birth certificate.

Judge Muya sentenced Mr Grant to one year imprisonment on each of the nine charges.

Mr Grant through lawyer Chacha Mwita, asked Appellate Judges Alnashir Visram, Martha Koome and Wanjiru Karanja to quash his conviction saying that the judge erred in law.
