Former Trans Nzoia Senator Henry Ole Ndiema on Thursday finalised presenting witnesses before the Eldoret High Court in an election petition in which he is challenging the election of Senator Michael Mbito.

Rodgers Ndiema, who was the former senator's Endebes Constituency tallying center chief agent, was last to testify.

He told the court how form 38A of one of the polling stations in the county was found in a maize farm.

Ndiema further said returning officers for four polling stations in the constituency never presented the results and at some point, police had to be dispatched to look for them.

The witness, however, had a had time explaining to the court of how he knew that form 38A from one of the polling stations had been found in a maize farm.

"You have told the court that there was a form retrieved from a maize farm, do you have any evidence to proof that," Benson Gitonga, lawyer to Senator Mbito asked the witness during cross-examination.

"That is what we were told by the police who had gone to look for the missing results from four polling stations," answered the witness.

"So it will be right to say what you've told this court is hearsay and you didn't witness it," the lawyer asked with Ndiema answering in affirmative.

The former senator presented seven witnesses to argue his case in which he is seeking nullification of the Trans Nzoia Senatorial election results.

On Friday, hearing for the case continues before Justice George Kimondo with the IEBC expected to present two witnesses.Senator Mbito will be allowed to present three witnesses.
