National Assembly Majority Leader Aden Duale on Thursday asked the court of appeal to disregard the former deputy speaker Farah Maalim disregarded.

According to Duale, he won the seat in a free and fair manner. 

He has insisted that his win reflects the will of the people of Garissa Township even as Maalim continues to fight for what he terms as electoral injustice suffered by the voter. 

Duale wants the court to reject the appeal on the grounds that his rival filed the case late.

 “The said notice of appeal was filed seven days after the mandatory timelines and as such, Maalim has failed to institute the appeal within the prescribed time,” reads Duale's application. 

Mr. Maalim went to the Appellate court to challenge Duale’s victory after the High Court upheld his re-election as Member of Parliament. 

In his ruling, High Court judge Justice Hedwig Ong'udi ruled that Maalim has failed to provide the court with sufficient evidence that could lead to the nullification of the outcome of the poll. Maalim wants Duale’s win to annul for a fresh election in accordance with the constitution.
