Suleiman Mwamlole Warakah, Mwarapayo Mohamed and Hamis Mwamrezi want the court of appeal to allow them to take over the case from the first petitioner.

This is after the first petitioner, Mwamlole Tchappu Mbwana, had published a notice to withdraw the petition on a local daily.

The three petitioner withdrawal challenger say they are so shocked why Mbwana wanted to withdraw the case, saying they did not understand the motives behind his move.

Mr. Warakah said he has been moving around in the county where he realized many residents are supporting the petition to challenge the Governor's victory.

"I have been instrumental in coordinating meetings in all constituencies in the county where over 150,000 residents have expressed support for the application," said Warakah, as quoted by the Standard.

Earlier the first challenger, Mr. Mwana, had his petition dismissed by the High court on 16 November 2017, he went ahead and appealed the case. His motives behind withdrawing the case are not yet known.

Yesterday, the three challengers' lawyer, Murambi Simiyu, told the Court that his clients got the desire to have the case heard and determined afresh.

"The applicants do not wish to have this appeal withdrawn. Their desire is to have the matter heard and determined on merit," said lawyer Simiyu.

The other interested party in this appeal is former cabinet secretary minister Chirau Ali Makwere, who was also present in court when the three residents applied to be considered as the new petitioners. Makwere contested for the same seat on a Wiper party ticket.
