A woman has moved to court seeking to sue former Tana River Governor and his wife for unlawful termination of employment.

Ms Catherine Omwanza accused former ex-governor Hussein Dado, and his wife of allegedly failing to pay her after termination of her service.

Ms Omwanza told the court that she had been employed as a househelp at Mr Dado’s home for three years but was allegedly relieved of her duties without her dues in 2012.

She told Justice Onesmus Makau that she was employed in 2009 on a salary of Sh4,000 a month, which according to her, was below what she ought to have been paid.

She further claimed that both parties had agreed that upon her termination of service, the ex-governor and his wife would pay her a 12 months’ salary.

Ms Omwanza who is seeking Sh350,000 as compensation said she was supposed to receive a one-month notice salary of Sh10,656, annual leave for three years which amounts to Sh25,820, severance pay for three years which amounted to Sh16,037 and 12 months’ salary compensation of Sh10,656 per year.

Lawyer Jason Okemwa said that the case was filed in October 2013, after the respondents declined to meet her demands for unlawful termination adding that the former governor and his wife violated his client’s rights to earn a decent salary as stipulated in the labour laws.

The former governor admitted that Ms Omwanza was employed as a house help in his house following an interview process, and she was found to be fit for the job.

Mr Dado, however, denied that she was paying her Sh4,000 saying that, “contrary to what the claimant has submitted to the court, I paid Omwansa Sh8,900 per month,” read the court paper as quoted by Citizen TV.

The case will be mentioned on September 18.
