Independent Electoral and Boundaries Commission (IEBC) has vehemently defended victory of Kitutu Masaba MP Shardrack Mose.

In a petition filed by one Justus Omiti, PA to Ex-MP Timothy Bosire, IEBC argues that the outcome was free and fair.

"An election cannot be nullified because of minor administrative errors and irregularities. It can be nullified if the irregularities can affect the outcome of the results," said lawyer Paul Lilan.

Both parties were tabling final submissions before Judge James Makau who is set to determine date for ruling on Tuesday.

And Lilan, who was appearing for IEBC, accused the petitioner of relying on evidence submitted by Noah Akala, an IT expert.

"Any witness who presents himself as expert has to demonstrate his qualifications to the court which the witness never did," he argued.

Omiti, a voter in the constituency, argues that elections should be nullified since they did not reflect the will of people.

The incumbent beat ODM treasurer Timothy Bosire, who had served in the constituency for a single term.
