The bodyguard, Mr Nginyo Mwaura was being accused of allegedly failing to keep his firearm safely.

Mr Mwaura is charged with failing to keep secure his firearm, Glock 19 Pistol, on October 17, 2017.

Mr Mwaura was expected to appear before Nyeri Chief Magistrate Wendy Kagendo on Tuesday to plead to the criminal charge but he moved to the High Court in Nairobi seeking orders stopping his prosecution.

The prosecution led by State prosecutor Wesley Nyamache said there were orders issued by Justice George Odunga suspending the proceedings.

Justice Odunga had issued orders stopping the prosecution of Mr Mwaura until April 10 when further directions will be issued.

Mr Wanjigi in a different court has been accused of being in possession of firearm contrary to the Firearms Act.

The police had conducted raid at his resident in Malindi, Lamu County on October 16, 2017 and found guns and ammunition.

The office of the Director of Public Prosecutions had told the court that during the raid, police recovered seven firearms, some of which are considered as high power fire rifles mainly used by special forces and not civilians.

The businessman has however defended himself saying that the guns found in his possession were licensed.
