High Court Judge Dorah Chepkwony suspended the ban after a human rights group filed an application challenging the decision.

Human Rights and Justice (CFHRJ) moved to court to stop the ban from being effected claiming it had rendered many youth jobless.

The human rights group, under a certificate of urgency, further argued that the directive by Joho’s administration has adversely affected commuters and tuk tuk operators in the county.

CFHRJ executive director Julius Ogogoh said that the ban was illegal, wrong and ill-advised adding that the ban was imposed without consulting the tuk tuk operators.

“If the ban is not challenged, all the commuters and owners of the three wheelers and the operation of the business will be negatively affected since they entirely rely on the same for their daily income,” said Mr Ogogoh as quoted by Daily Nation.

The human rights group had sued the clerk and the Mombasa county government.

Justice Chepkwony while issuing the order directed the human rights group to file the main application and serve it on the respondents, who are the clerk and county government.

Governor Joho banned the registration of the three-wheelers in January over claims that they were causing congestion.
