A ruling by Nyamira High Court has at least settled a matter that almost split NASA coalition partners over August polls.

Steve Mogaka (Wiper) had challenged elections on of Vincent Kemosi (Ford Kenya) as West Mugirango MP, a matter that generated heated debate within NASA coalition.

With Mogaka being a close associate of Kalonzo Musyoka and Kemosi a confidant of Moses Wetangula, pressure was on Raila Odinga to chip in and solve the matter.

But in his ruling, Judge James Makau noted that affidavits sworn by petitioner, Steve Mogaka, had been commissioned by an employee in his Musyoki advocates, an illegality by itself.

"The affidavits were commissioned by persons that were unauthorized thus rendering the petition defective," read part of the judgment.

He further said: "I hereby dismiss the petition with costs to the petitioner and I so direct.'

The ruling closed a four months battle that saw Wiper and Ford Kenya politicians openly showing differences on public.

Mogaka, on his part, says the matter is far from over, adding that he may appeal the ruling at Kisumu's appellate court.
