Tong’i said that for devolution to succeed, it requires support from all agencies and absolute dedication from the county governments.

The Legislator observed that transitions are difficult and complex, and if stakeholders don’t engage continuously, they risk misunderstanding each other and coming short of the constitutional promise.

“We all know that through devolution various counties are developing and we are calling for all officials to support the devolution,” he added.

He stated that whereas the functions of most Judicial agencies are not devolved, he is aware of the fact that the services they offer are to benefit the Kenyan people wherever they are.

“Devolution needs support by national level institutions guided by the constitution and the law, but beyond that, devolution should also be driven by a copious amount of goodwill,” said Tong'i.

The Mp stated that the constitution in article 6 requires all Kenyans to conduct their affairs in the spirit of cooperation and consultation, adding that article 6 (3) specifically instructs Judiciary to ensure reasonable access to its services in all parts of the republic.

He further clarified that county governments are not development agencies, or private sector actors, but rather governments that are elected directly and possess both executive and legislative authority.
