Nakuru East member of parliament was on Wednesday arraigned before a Nakuru court for allegedly disposing waste on undesignated public land.
David Gikaria was accused of allegedly exposing solid and liquid waste on a public highway on different occassions between July 11 and July 16 this year within Nakuru town.
National Environment Nanagement Authority moved to court to sue Gikaria for dumping the waste on an area that is not meant to be for waste disposal. He is said to have led a team of members of the public to Geoffrey Kamau highway to dump crushed wines and spirits bottles at the two roundabouts.
Gikaria through his lawyer Ochang Ajigo said that his client was not ready to take plea to the charges because the charge sheet had defects.
“The charge sheet is signed by one Margret and its letter head is that of the Nakuru County government, NEMA have not been devolved into the counties so that the county can have the jurisdiction to charge people," Ajigo said.
The lawyer said that it was discriminatory and his client’s rights were being infringed by the court by using a document signed by the official from the County Government.
Resident Magistrate Judicaster Nthuku, ruled that in such an event the accused was deemed to have pleaded not guilty.
He was released on a bond of Sh. 300,000 with one person as a surety and a cash bail of Sh. 200,000.
The case will be heard on October 19.
