Two men’s appeal for life sentenced was heard on Monday at the Nakuru High court, saying the court was biased.

Mureithi Mwangi was sentenced to life on November 17, 2009 for defiling a seven years old girl by a Nakuru Magistrate. Mwangi defiled the minor at Edgewood in Nakuru district, they lived as neighbors and the child preferably called him ‘uncle’.

Mwangi said that those who testified in the case against him were all family members and he prayed that the court reverse the sentenced. According to police, Mwangi lured her and her younger sister to his house after asking them where her parents were. He removed her pants and did the act and later ordered them to leave.

During the judgment, Mwangi mitigate that he has two sisters and his mother is sick.

Jason Wambugu was also sentenced to life for defiling a 3 years old child and another 10 years sentenced for indecent conduct on a child by chief magistrate in Nyahururu.

According to police, Wambugu is an uncle to the complainant and he took advantage of the relationship between the families to defile her.

Her mother, Mary Isieli said that she realized that her daughter was unable to stand up and walk and she investigate and took her to Olkalou police station and later to J.M Kariuki Hospital.

The prosecution said that her younger sister testified before court and her evidence was the same as of the complainant.

Dr. Peter Nginyo who testified before court after treating the minor confirmed that she was defiled saying that there were bruises at her entry to vagina as a result of force.

State counsel Nelly Ngovi said that the appeals lacks merit and she prayed that the court uphold the sentences saying that two were given opportunity to defend themselves during the hearing but they only challenged the prosecution.

Judgments to be read on October 5.
