The high court has temporarily blocked the arrest of Machakos Governor Alfred Mutua over abuse of office claims.
Justice Isaac Lenaola ruled against any investigation or arrest of the governor over alleged irregular procurement of motor vehicles.
Governor Mutua through his lawyer Wilfred Nyamu on Tuesday moved to court seeking orders to prevent the Ethics and Anti-Corruption Commission (EACC) from investigating him over the corruption allegations.
"Dr Alfred Mutua is not guilty of any charges leveled against him. This is a political fight fueled by his opposers. County officers are already in police custody over the same issue,” said Nyamu.
During his ruling, Justice Lenaola stated that investigation to the allegations against the governor should be halted until the case is decided.
The judge asked for more time to investigate the request by the governor not to be investigated over irregularities in the purchase of 14 county vehicles, stating the issue needs more knowledge.
The Director of Public Prosecution (DPP), through Lawyer Lillian Obuo had presented a request to the court not to halt the investigation stating there was enough evidence.
The case will be heard on February 5, 2016.
