Kenya Ports Authority (KPA) has denied disobeying court orders in a case filed by two Mombasa freight stations, owned by Mombasa Governor Hassan Joho's family.

KPA through its lawyer Nani Mungai, said the freight stations want to use the court to be nominated to handle cargo every week.

In the case, the two freight stations, through their lawyers Paul Buti and Mohammed Balala, are seeking to sue Kenya Posts Authority acting managing director Catherine Mturi and the head of litigation, Ms Addraya Dena.

KPA's lawyer however told the court that the purpose of the case by the freight stations was to secure nomination contrary to the licensing agreement.

Mr Mungai added that the freight stations are seeking commercial advantage through the court.

“The applicants want to be nominated every week,” said Mungai.

The freight stations in their application want the two officials summoned to court to show cause why they should not be committed to civil jail for allegedly refusing to obey court orders not to stop operations at Autoports Freight Terminals Limited and Portside Freight Terminals Limited.

In the applications, lawyer Balala accused Ms Mturi of failing to obey a January 25 court order to put on hold the port’s decision to suspend the nomination of containers to Portside Freight Terminal.

In January, KRA officials raided the two freight stations and ordered their closure claiming that the facilities have been handling stolen and smuggled goods.

Justice Anyara Emukule will deliver his ruling on March 23.
