The hearing date of a malicious damage case facing a Nakuru MCA was on Monday fixed after the prosecution said that it needed to amend dates on the charge sheet.

On August 28, London MCA, Francis Njoroge denied destroying a perimeter wall valued at Sh10 million a property of Beyond Housing Co-operative Society, a private organisation at London Estate on August 23 in Nakuru County.

Last week (October 5), the case failed to proceed after the prosecution requested to be allowed time to amend the charge sheet which on Monday was not yet complete.

Njoroge’s lawyer, Harry Gakinya termed the move by the prosecution as frustrating and a waste of time.

“The mentions of this case are only wasting our time since the prosecution had enough time to do that. They actually had months,” said Gakinya.

Senior Principal Magistrate Liz Gicheha allowed the prosecution's application to adjourn the case and said that the trial will kick off in February 2, 2016, giving them months to amend them.

According to police records, Njoroge together with others allegedly went to the piece of land located near Kobil Petrol Station and demolished the perimeter wall. 

The police also say that he was in the company of young men armed with bows and arrows and chased away the guards.

The complainant, John Oyunge went to the scene and later informed the police about the incident.

On August 26, the MCA presented himself at Kiamunyi police Station where he was escorted to Central police Station and released on Sh10,000 cash bail.

The MCA is out on a Sh2 million bond.
