The hearing of a case in which a Njoro teacher had been charged with defilement and sexually molesting five others was on Tuesday and Wednesday heard in camera.
Paul Gicheri, a Kiswahili teacher at Njoro girl’s high school was accused of allegedly defiling one of the students and sexually molesting other six. He allegedly altered the examination grades of the students to gain sexual favors from them.
Gicheri denied all the charges before Chief Magistrate Doreen Mulekyo and his lawyer Karanja Mbugua said that his client’s rights were infringed after he was forced to undergo tests on the day of arrests.
“The accused was forced to undergo the tests of STI's, syphilis and others contrary to article 31, the state invade his place of work and took his camera and laptop, the complainants have tried to call the accused cell phone,” he said
State counsel Nancy Ngovi dismissed the claims saying those were just mere allegations unless the defense has reported them to the police and therefore the court must not take them serious.
“Those are just allegations, the constitution under article 36 of the sexual offenses supports that necessary samples must be taken when it comes necessary to ascertain the perpetrator, the exhibit he is saying; the laptop and camera were recorded through the teachers service commission (TSC)” she said
Chief Magistrate Doreen Mulekyo said that the prosecution must be put on notice and go records regarding issues raised by the defense.
