A primary school teacher was sentenced to 30 years in jail by a Nakuru court on Monday for defiling a 14 year old pupil.

Solomon Ngatia Wachira was found guilty of defiling a pupil whom he tutored at his house after school on October 19, 2013 at Railways Estate.

He denied the charges before Resident Magistrate Judicaster Nthuku and the case proceeded for hearing with five witnesses testifying.

The complainant in her testimony told the court that she was with other two pupils at the teacher’s house, of which the two left and the teacher defiled her before escorting her to her mother’s home.

The minor also forgot her sweater at his home and she later recovered it from school.

The victim also told the court that she has had sex with the teacher on two occasions, on October 19, 2013 they had sex and the accused told her to lie to her mother that she was with another man who defiled her.

Her mother said that she saw the minor with a man at around 8:30pm, the man run away and when she pursued them, she found her at teacher house.

She called the minors’ father and took her to Rift Valley Provincial hospital where she was examined and found to have had a broken hymen.

The minor was taken to Nakuru police station where she recorded a statement.

The accused in his defense told the court that he escorted the minor to her home and she later came back to say that she has been defiled by another man who fled away.

In his mitigation, Mr Waweru appealed to the court to consider him as a first offender, he has a young family and prayed for leniency.

Magistrate Nthuku said that cases of teachers molesting pupils had risen in schools and must be controlled, she also said that the prosecution had proven the case beyond reasonable doubt and sentenced the accused to serve 30 years in jail under section 215 of the criminal procedure code.

The court also said that the accused has the right to appeal the sentence.
