A robbery with violence suspect on Monday failed to take a plea before a Kisumu law court due to poor health as a result of injuries inflicted on him by a mob.
Kisumu Principal Magistrate Harrison Adika said the accused, George Otieno, was in a poor health condition to take a plea in the charges facing him.
Magistrate Adika slammed the prosecution for hurriedly bringing the case before him without putting into consideration the health condition of the accused.
"It is unjustifiable for the prosecution to present a suspect before this court, without considering his state. The prosecution is therefore ordered to take the accused for treatment before proceeding with the case," the magistrate ordered.
Otieno is alleged to have robbed Stephen Okal, a Mamboleo Estate resident, on Sunday evening.
According to police records, the accused was nabbed by a mob in the area who beat him up before he was rescued by the police who were patrolling the area.
Otieno allegedly attacked Okal in his home, before making away with a mobile phone and Sh50,000 in cash.
Magistrate Adika directed that a full medical report be presented before the court to show that the accused is indeed in good health to proceed with the case.
He ordered the prosecution to report back in seven days.
