The High Court in Mombasa on Thursday ruled that two suspects charged with the murder of 60 people in Mpeketoni have a case to answer.
Mr Mahadi Swaleh Mahadi alias Jesus and Ms Diana Salim Suleiman will be put in their defense after the prosecution tabled enough evidence indicating that they were involved in the massacre.
The two are accused of allegedly being behind the killing of 60 men and women in June 2014 at Mpeketoni Township and Kaisari Village in Lamu County.
Investigating officer Jeremiah Ikiao told the court that Mr Mahadi was positively identified by one of the witnesses as one of the attackers.
Mr Mahadi was also accused of allegedly being in contact with the militants who carried out the attack and participated in the attack.
“Police investigations established that Mahadi actively participated in the killing of non-Muslims in Mpeketoni,” said Ikiao.
The accused persons who denied the charges before the court said they will bring witnesses to prove they are innocent.
Judge Martin Muya in his ruling said that the evidence submitted against the two indicates they should be put on their defence over the killings.
