Mombasa Republican Council (MRC) Chairman Omar Mwamnuadzi has been released on a Sh200,000 bond.
Resident Magistrate Paul Mutai issued the orders following an application by Mr Mwamnuadzi who asked the court to release him on bond to enable him to seek medical attention.
The prosecution led by Ms Cecilia Wakoli had however opposed the bond application, saying the accused has several criminal cases in Mombasa.
Magistrate Mutai in his ruling granted Mr Mwamnuadzi the bond and ordered for his release pending the case hearing, saying the accused has a constitutional right to be freed on bond.
The magistrate noted that there was no compelling reason to deny the accused bond.
“The accused who has several criminal cases has not been convicted and there are no reports of him absconding hearings,” said Mutai.
Last week, Mr Mwamnuadzi told the court that he was sick and needed medical attention after the police beat him up during his arrest.
Mr Mwamnuadzi who is facing three charges of allegedly being a member of an organised criminal group, illegally contributing and receiving money and incitement to violence was arrested on January 24, 2016 at his Ng’ombeni home in Kwale.
He was allegedly found in possession of Sh210, 200 for furthering MRC activities and documents with the words “Pwani Si Kenya” written on them.
The case will be heard on March 28, 2016.
