There was a sigh of relieve for Nakuru East MP David Gikaria on Wednesday after the National Environment Management Authority  withdraw a dumping case it had filed against him in a Nakuru court.

Nema opted to withdraw the case after the parties settled the matter outside the court.

State prosecutor Moses Mburu told the court that the negotiations between both parties have been completed and the parties have agreed to drop the case against the MP.

Gikaria had been accused of dumping solid and liquid waste on a public highway on different occasions between July 11 and July 16 this year within Nakuru town.

The environment watchdog moved to court to sue Gikaria for dumping the waste in an undesignated area. 

He is alleged to have led the public to Geoffrey Kamau highway to dump crushed wines and spirits bottles at the two roundabouts.

Gikaria denied the charges before Resident Magistrate Judicaster Nthuku and was released on a bond of Sh300,000 with one person as a surety and a cash bail of Sh200,000.

Nema and Gikaria had on several occasions urged the court to grant them more time to negotiate on settling the matter outside of court but delays arose thus pushing the matter.

He is said to have been provoked by the move to delay the withdrawal of the case and termed it as a political move meant to frustrate him as they had agreed for an out of court settlement.

Principle magistrate Wakumile Ndururu allowed the withdrawal of the case against the legislator terming it a good move for the parties to negotiate.
