The case against five people suspected to have taken part in the April’s Garissa massacre in which 148 Students from Garissa University lost their lives has been adjourned and will be heard on different date. 

The judge who was supposed to hear the case on Tuesday in a Nairobi Court said that he would not be available for the hearing.

The prosecution was informed that the Trial magistrate Daniel Ogembo would not be available because he was preparing to appear before the judges and magistrate vetting board for vetting. The suspects, Mohamed Ali Abikar, Hassan Edin Hassan, Sahal Diriye Hussein, Osman Abdi Dagane and Rashid Charles Mberesero (a Tanzanian), are accused of being behind the Garissa university attack in which 142 students and 6 members of security forces perished. The suspects denied the accusations in June when they last appeared before the court.

However State Counsel Duncan Ondimu has criticised the adjournment terming it as improper.

“We already had witnesses lined up ready to testify on Tuesday and what we are getting is not acceptable at all” he said.

The defense has also accused the prosecution of failing to supply them with all the witness statements. The prosecution has been given two weeks to supply the defence with all the witness statements.

Further directions will be given on September 1.
