Nakuru High Court on Thursday adjourned the case of five convicts who killed their fellow inmate at the Naivasha Maximum prison.

Dismas Ouma, Daniel Njoroge, Denis Mutabari, Fredrick Macharia and Francis Mwangi allegedly killed Joseph Ong’are at the Naivasha Maximum prison on the July 3 and 4 2011.

According to the police, the deceased was found covered with blanket in his bed with severe injuries and his hand cut.

The Director of Public Prosecutions had written on the behalf of the republic that the five inmates be charged with an offense of murder.

The accused were investigated and a report presented before court on October 11, 2011 that the accused were inmates who were already saving life imprisonment.

Appearing before Justice Hanah Omondi on October 25, 2011, they all plead not guilty and they were all remanded at the Naivasha Maximum prison.

The lawyers of the convicts told the court on Thursday that their clients needed to be supplied with statements and the DCIO reports supplied to the defense.

They also said that were not ready to proceed with the scheduled hearing upon issues of threats and harassment in the prison that needed to be addressed.

Fredrick Macharia’s lawyer, Steve Kabita told that the court that his client’s life was in danger and was seeking to be moved to another prison, he also applied for bond terms.

“The life of Denis Mutabari is in danger because of the harassment and harsh treatment by the prison wanders, it’s the duty of the state to secure the inmates, I prayed for the court to give him a bond because I understand he is on remand,” he said

Dismas Ouma’s lawyer, Wambei Mkomere said that Naivasha prisoners were the accused are being held has a lot of stigmatization from the wanders regarding the case, he seek transfers to another prison.

“My client has been beaten several times even on Wednesday at the Nakuru GK prisons, he knows the one Koech who beat him yesterday, they are normally brought to Nakuru a week before the case,” he said

Justice Maureen Odero ordered the officer in charge of the prison to investigate and write a about the allegation of mistreatment of the accused within 14 days.

The case will mentioned on July 29 for bond application and heard on September 29.
