A 69-year-old man arrested for possessing 30 kilogrammes of marijuana with a street value of  Sh70,000 at Kibuye market in Kisumu has been granted bail. 

Peter Nyamita was ordered by Kisumu chief magistrate Lucy Gitari to pay Sh10,000 cash bail and to reside at the address he gave to the police. He was also ordered not to interfere with witnesses. 

"He is an elderly citizen and of ill-health. As such the State would not suffer any prejudice if he is released on bail," she said. 

However, Peter Makombe (20) and Charles Mugilwa (36), who are jointly charged with Nyamita, were remanded in custody. Gitari said the two were not proper candidates for bail as they were likely to abscond. 

“The pair might fail to stand trial so it will be best if they are remanded in custody,” she said. 

The three are being charged with dealing in banned drugs. 

It is alleged that on July 5, Makombe arrived from Nyando with 30kg of marijuana and left it in a stall at Kibuye market from where he made arrangements with Nyamita to collect the bag. 

The court heard that Nyamita gave Mugilwa the bag to take to Manyatta but he was intercepted by the police who then arrested him. 

Nyamita and Makombe were later arrested after they claimed ownership of the bags.

The case will be heard on July 27.
