The management of a Nakuru funeral home was on Thursday appeared in court over alleged failure to pay a contractor two years after work was completed.

Directors of Umash Funeral Home were accused by a borehole drilling company of paying only part of the dues and reneging on the rest after they had drilled for them a borehole.

Nickson Kariuki Thuo told Senior Principle Magistrate Liz Gicheha that his Fountain Vent Company drilled the borehole two years ago in Lanet.

The court heard that they agreed on an initial cost of Sh1.5 million to drill 150 metres for water, but they only paid Sh1 million and refused to pay the rest after they struck water.

He added that even after reducing the balance to Sh492,000, the funeral home still refused to pay.

He further accused the directors of walking out on the agreement and hiring another company to finish the project even after they had struck water for them and only remained with fixing the pumps.

"We did all the difficult work and when we were about to finish they walked out of the agreement and hired a different company to finish the task," he said.

He pleaded with the court to compel them pay up the amount they claim to be owed.

However in a swift rejoinder, the funeral home dismissed Thuo's claims adding that they didn't complete their task and were always shifting goal posts in regard to the pay.

Peter Kamau told the court that it was, in fact, the contractor who owed them money.

"Look, we paid them so much money for work not completed. They should refund us back some money if they are honest," he said.
