A man suspected of mugging puzzled Maseno court on Monday by saying he was in custody wrongly as the police were using him as a scapegoat.

Harison Owemba told Maseno Resident Magistrate Philip Oilo that he was picked by police on Saturday while conducting his business and put in custody without anybody explaining the offence committed.

“I am wrongly accused and I don’t know what I'm doing here because I'm innocent. Police just arrested me while I was conducting my Mukokoteni business. I beg to be released because it is unfair for me to be languishing in a police cell for no known offence,” said Owemba.

The accused had been arraigned in court for allegedly mugging a secondary school teacher in Maseno and stealing mobile phone and money.

The prosecution desk, however, told the court that the complainant had positively identified Owemba as the one who mugged him on July 24, 2015.

Magistrate Oilo, however, said the allegation labelled by the accused are serious and they should be investigated to determine who is telling the truth.

The prosecution desk was given until next Monday to investigate the claims by he accused and present findings before the court next week on Monday when the case will resume.

Owemba who pleaded not guilty to the mugging offence allegations was released on a cash bail of Sh5,000.
