A Kisumu court on Thursday denied a Burundi national bail for staying in the country illegally.

Chief Magistrate Lucy Gitari denied Leonard Rizenzo bail after the prosecution desk successfully opposed the application on the grounds that the accused might run away from the country in the event that he is released from custody.

According to the prosecution desk, the accused was arrested in Kisumu at the Aga Khan Hall on July 14, 2015 selling curios, when he was apprehended he produced a business permit.

The court was told that the accused failed to produce a Kenyan identification card, and instead produced a Burundi national identification card.

Upon interrogation Rizenzo revealed that he has been living in the country for the past nine months and he was in the process of applying for a Kenyan identification card.

The prosecution desk, however, asked the court to extend the accused’s stay in remand while they are still carrying out more investigations to determine how he acquired business permit without a Kenyan national identification.

Rizenzo was remanded in custody for the next seven days when the case will be heard again.
